This is called Trade Dress infringement, meaning that a company intentionally tries to confuse the consumer by "stealing" a reputable company's product look. It would be like Makita starting to producdea line of bright yellow cordless power tools and calling them "Dewals" power tools. Many times, these cases are judgement calls...but not one! This is a clear case of piracy. |

Location: Louisville, OH 44641 | Ebay is currently being sued by a high end jewelry company for being such a haven for rip off Chinese jewelry. The jewelry bought 50 items on Ebay that were obvious and intentional knock-offs and took them to Ebay's lawyers and asked for an explanation. Fleabay says they're just a marketplace and can not be held responsible criminal activity that occurs on Ebay. They claim Ebay is simply far too huge to police for this type of thing. |

Location: Central Oregon | Get used to it. If there was any way to prosecute blatant rip-offs of an established product Harley-Davidson would own the Yamaha, Honda & Kawasaki motorcycle companies. They all stole the designs for their big bikes from Harley-Davidson. They even go so far as to put fake chrome plated plastic covers on their bikes in various places for no other reason than to make them look like the real deal. There's nothing wrong with the bikes, they run great & all that, but they're still rip-offs.

| Ovation can tell Ebay to cease and desist this auction. I know Ebay cancels auctions for companies all the time when the companies name is used to help promote the product being sold, and the product is not genuine.
I had a giant Cigarette lighter I was selling once on the bay and I mentioned that it "Looked Like" a Zippo lighter. Not that is was in any way a Zippo lighter it just had the basic shape. Zippo lighter company had ebay shut down my auction three days into it just because I used their name?
I am sure Ovation could just do a check on Ebay to see what guitars are running under their name and contact Ebay with a complaint and Ebay will honor their wishes. Got to admit it is a good looking guitar for 50! Would make a nice learning guitar if it was a 6?

Location: 6 String Ranch | All that would take time and effort. Your trade marks are only as good as your protection of them. I doubt that marketing is worrying about this, they're worrying about how to get GC to take another 1000 LP conga drums. |

Location: Louisville, OH 44641 | I sent Ebay a complaint about this auction and also gave them a link to the Ovation Elite 1718 page. In addition, I emailed the seller and let him know I was contacting Ebay. We'll see what he says.
I know this may be a small issue for Ovation but what I've found, at least in the industry I work in, is companies that take the time to make a stink about this, get a reputation for defending their products. Then the rip-off companies choose to copy someone else's design. |

Location: 6 String Ranch | Jim, that is true. Good example; Gibson and the Les Paul shape. It had lapsed into public domain. Henry has been so "active" in chasing down copies that he's actually "reaquired" the rights in a common law fashion. Mostly nobody wanted to take the time AND money to fight him so he got it. |
