Won a new solid acacia-koa tenor on e-bay for $99 (with small disclosed fretboard flaw, so obviously factory second) plus $70 shipping. I noticed a dark line on the back and on closer inspection detected a fine crack at the inside where someone had put some dark paint in resulting in the dark line on the back. But there definitely is a crack and it's bright when I hold it against a light. They were obviously aware of the issue and tried to cover it up, but did not disclose in the auction, and I would not have bid if I was aware of this. I am asking for a replacement with same model and I don't want to incur any further expenses. Seller offers $70 refund, or $169 if I ship it back to Taiwan at my cost. I don't go to e-bay often, so am wondering if some of the more seasoned eBayers here could offer some advice. Thanks. | ||

One thing, do not make a side deal with the seller that may violate Ebay rules. I have heard a story or two that went down this road. The road led to a dead end when the seller didn't follow through. When this happens, you can inadvertently throw away the Ebay protection. | ||

Joined: February 2014 Posts: 714 Location: moline,illinois | Read the fine print in the auction,most sellers say full refund if you pay return shipping.you can open a dispute with eBay but that doesn't guarantee you any money, if you purchased with paypal which I hope you did open a dispute with them also.time lines for dispute filings also vary last i knew you had 45 days with eBay but only 30 with paypal(i got stung by that once so watch your calendar). if the damage isn't to bad you might consider taking the 70$ and call it a lesson learned in buying cheap overseas products cause they're probably not just going to ship you a new one unless you send the old one back.good luck conflict resolution with eBay can be a big headache | ||

Go to the drop-down menu next to the item in your "My eBay Purchase History"... Pick "Resolve a Problem" Then pick "I received an item that wasn't as described" Then pick "Report that you received an item that wasn't as described" Then follow the directions to open a dispute. After a few days when the Seller doesn't offer a full refund including shipping both ways... Escalate to a Claim. Then the Resolution Center will give you a result. All this make take a few days to a coupla weeks. Just box the Uke back up and wait. eBay will side with the Buyer in most cases. Demand a return for Full Refund. No side deals. No partial refunds. If the Seller refuses, eBay may just refund your money and let you keep the item. Or (this has happened to me) eBay may send you a UPS label to ship it back... Then give you a full refund once the item is delivered. Also, if eBay denies your claim you can Appeal that decision. Be sure to have photos ready. Especially get a photo of the crack. Any "Tems of Service" that the Seller added to the listing are meaningless. eBay has it's own rules and those are the rules that you play by. Best of Luck. I did the escalation of claim as OMA suggested and apparently eBay rules state that they only issue a refund when the item is returned at buyers cost. Shipping the little thing from Canada to Taiwan would be around $300, so guess in hindsight I should have taken the partial refund which now is off the table. Will have to figure out how to leave a comment for the public. | ||

As to leaving a comment for the public. You can leave negative Feedback on eBay. You can also leave comments on other sites that this company sells on, like Amazon. | ||

The eBay site is pretty difficult to navigate and there's a lot of hidden small print scattered around. This is only the third time I used it for a larger item, and of the three times only one was satisfactory. I hear it was pretty good in the beginning as an auction place for individuals, but now I just see it populated by professional big-scale scammers, which I guess is good for corporate profit. Go to "Customer Support" at the top of the webpage.HERE Search for "Appeal" and it should offer you "Can I appeal eBay's decision in my case". Click that, and go to that page. Then go to the "Resolution Center" I cannot experiment any further because I don't have any cases eligible for Appeal, or Claim. But while you are there, there is also a tab at the top to "Contact eBay". Eventually it will take you HERE Click "Call Us". (it opens a pop-up) It will give you a phone number and a code. You can call them and talk to a real person. Offer to let them see photos and such. They should instruct you in an appeal. Since they seem to have removed the instructions from the website. AMEX his intervened on our behalf, telling eBay/Paypal that their "returns @ buyer's expense" does not pertain to fraudulent transactions, bait-&-switch, damaged/defective merchandise. AMEX has stood firm for us by issuing 100% chargebacks and insisting that the merchants retrieve their defective merchandise at the merchants' expense. Paypal has threatened to freeze our account if we rely on AMEX Dispute, rather then eBay/Paypal Dispute, but our Paypal/eBay accounts have never been adversely affected. It appears that AMEX has a dedicated group just to deal with eBay/Paypal. | ||

And contrary to what they might say, you have something like 60 day to file a PayPal claim. But since eBay/PayPal are the same company, file a claim with your CC. You probably have longer to file an AMEX claim. They might just do a "Chargeback" and let you keep the wall hanger. | ||

In the meantime you'll have a Delivery Confirmation number to provide to Ebay, in addition to disputing the sale through Amex. | ||

There are some sellers that will reimburse the shipping, out of fairness, but those are few and far inbetween. There are some sellers that will try to make it right by issuing a partial refund (because if you ship it back and are refunded the price, the seller is also out what he paid to ship it to you). Always something to factor when on an eBay purchase.

Joined: December 2003 Posts: 852 Location: Canada | So to conclude the case, shipping it back to Taiwan would have been close to $300 (yeah Canada shipping is not pretty) so I decided to take the sellers offer of a $99 refund, and keep the cracked uke for the shipping cost. Maybe I will post in the BFLG and fill the crack with glue, though it's not very accessible and my dexterity is limited. And this is what she looks like:
